The Kwankwasiyya Movement has raised concerns over what it described as a growing pattern of conflicting judicial pronouncements across Nigeria, warning that the development could undermine democratic stability.
In a statement issued on Thursday, the movement cited the recent judgment by Justice Bello Kawu of the Federal Capital Territory (FCT) High Court, Abuja, in a case involving the New Nigeria People’s Party (NNPP), describing it as controversial and indicative of a wider trend.
The group said the development reflects an increasing tendency by some courts to issue orders that appear to overstep constitutional limits, create confusion, and raise concerns about neutrality and due process.
It noted that similar judicial interventions have been witnessed in the internal affairs of major political parties, including the Peoples Democratic Party (PDP), Labour Party (LP) and the African Democratic Congress (ADC).
According to the movement, such actions have often deepened internal disputes, weakened party structures, and created room for political manipulation.
Kwankwasiyya also expressed concern over what it described as the rising practice of courts of coordinate jurisdiction issuing conflicting rulings on similar matters, as well as entertaining cases already under appellate consideration.
It warned that such trends could erode established legal principles, including stare decisis, and undermine the consistency of the judicial system.
The statement further said the situation was fuelling public perception that the judiciary was being drawn into political contests, a development it said could weaken public confidence in the courts.
It cautioned that continued controversy surrounding judicial decisions could pose risks to Nigeria’s democracy, especially as the country prepares for future elections.
The movement called on opposition parties to unite and resist any alleged misuse of the judiciary to weaken democratic opposition.
“This is not just a partisan issue but a national concern that requires collective action to safeguard the rule of law,” the statement said.
It urged stakeholders to adopt lawful and peaceful measures, including engagement with civil society and raising awareness on the issue.
Kwankwasiyya also called on the National Judicial Council (NJC) to review the situation and address concerns over conflicting and controversial rulings.
It further urged judicial officers to uphold professionalism and adhere strictly to principles of fairness, due process and constitutional order.
The movement also cautioned political actors against resorting to forum shopping and judicial manipulation in resolving party disputes.
It reaffirmed its commitment to the protection of democratic values and the promotion of justice and the rule of law.
