Kano Govt Clarifies Position on Durbar Restrictions, Emirate Dispute

The Kano State Government has cautioned traditional rulers, religious and community leaders, political actors and members of the public against statements or actions capable of encouraging disobedience to lawful directives or disturbing public peace.

The warning followed a circulating video in which the Sarkin Dawaki Babba, Alhaji Aminu Babba Dan’Agundi, expressed views on the recent restrictions on Durbar activities and offered his interpretation of the ongoing legal proceedings concerning the Kano Emirate.

In a statement signed by the Special Adviser to the Executive Governor on Justice and Constitutional Matters, Aminu Hussaini, the government said while citizens have the right to express opinions on matters of public interest, the interpretation and enforcement of court orders remain matters for the courts.

The statement said an individual’s interpretation of a subsisting court order does not, by itself, give such a person the legal authority to disregard a directive issued by a competent public authority.

It advised anyone who believes that a government directive conflicts with a court order to seek judicial clarification or pursue other appropriate legal remedies, rather than declaring an intention to disregard the directive or encouraging others to do so.

The government also urged all stakeholders to allow the ongoing judicial proceedings concerning the Kano Emirate to run their course without prejudging the outcome or using the matter as a basis for confrontation between citizens and constituted authorities.

“Legitimate disagreement may be expressed; legal grievances should be pursued through the courts and lawful directives remain binding unless and until set aside, suspended or otherwise varied by a competent authority,” the statement said.

The Office reaffirmed its commitment to the rule of law, constitutional rights, judicial independence and the peaceful resolution of disputes.

It further warned that the state government would not allow any individual or group to turn a legitimate dispute into a challenge to public order.

According to the statement, any attempt to mobilise people to defy lawful directives, obstruct lawful authorities or disturb public peace would be dealt with promptly and in accordance with the law.
